1. Agreement to Terms

By accessing or using the Custom Packaging website (custompackaging.us) and our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms constitute a legally binding agreement between you and Custom Packaging and are governed by the laws of the United States.

2. Services

Custom Packaging provides custom packaging design, printing, and manufacturing services to businesses throughout the United States. All orders are subject to our production capabilities, material availability, and these terms. We reserve the right to decline any order at our discretion.

3. Orders and Quotes

All quotes provided are estimates and are valid for 14 days unless otherwise specified. All pricing is in US dollars (USD). Final pricing may vary based on artwork requirements, material costs, and order specifications. An order is confirmed only after we receive your approval of the final proof and payment terms have been agreed upon.

4. Artwork and Design

Customers are responsible for providing print-ready artwork that meets our specifications. We offer complimentary design assistance. You represent and warrant that you own or have the necessary rights and licenses to use all artwork, logos, images, and content submitted for printing. You shall indemnify Custom Packaging against any claims arising from intellectual property infringement in materials you provide.

5. Proofs and Approval

Digital proofs will be provided for approval before production begins. It is your responsibility to carefully review all proofs for errors including spelling, grammar, color, dimensions, and design. Once you approve a proof, Custom Packaging is not responsible for errors that were present in the approved proof.

6. Payment Terms

All payments are due in full prior to production commencement. We accept all major credit cards, ACH bank transfer, and wire transfer. Approved credit terms may be available for established businesses upon application.

7. Minimum Order Quantities

Our standard minimum order quantity (MOQ) is 100 units. Certain products or customizations may have different minimum quantities, which will be specified in your quote. Sample kits are available for most products so you can evaluate quality before committing to a full order.

8. Color Variation Disclaimer

Due to inherent differences in digital screen displays, printing processes, ink formulations, and substrate materials, minor color variations between digital proofs and final printed products are normal and acceptable within industry standards. Custom Packaging shall not be liable for color variations that fall within commercially accepted tolerances. Customers requiring precise color matching are encouraged to request a physical press proof prior to full production, which may be subject to additional charges.

9. Shipping, Risk of Loss, and Carrier Liability

Standard production time is 2-3 weeks after proof approval. Rush orders are available at a 15% surcharge (7-10 business days). Orders with special or non-standard requirements may have a different lead time - a revised timeline will be shared with the customer upon review. Risk of loss or damage transfers to the customer upon handover of the order to the carrier. Custom Packaging is not responsible for lost, stolen, or damaged packages in transit; however, we will provide reasonable assistance in filing claims with the applicable carrier upon request. Delivery times are estimates and are not guaranteed.

10. Storage and Post-Delivery Conditions

Custom Packaging assumes no responsibility for the condition of products following delivery. Improper storage conditions — including but not limited to excessive humidity, extreme temperatures, direct sunlight, or exposure to moisture — may adversely affect product quality, structural integrity, and print appearance. The customer assumes full responsibility for ensuring appropriate storage and handling of all delivered products.

11. Design Responsibility

While Custom Packaging offers complimentary design assistance as a courtesy service, the final responsibility for reviewing, verifying, and approving all artwork, content, spelling, grammar, dimensions, colors, and design elements rests solely with the customer. Approval of a digital proof by the customer constitutes acceptance of all elements contained therein. Custom Packaging shall not be liable for errors, omissions, or inaccuracies present in customer-approved artwork or proofs.

12. Returns and Refunds

Due to the custom nature of our products, all sales are final once production has begun. If you receive defective products or products that do not match the approved proof, please contact us within 7 days of delivery with photographic evidence. We will inspect the issue and, at our discretion, reprint the order or provide a credit for defective items.

13. Force Majeure

Custom Packaging shall not be liable for any delay or failure to perform its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, fire, flood, war, civil unrest, governmental actions or regulations, supply chain disruptions, material shortages, labor disputes, or failures of third-party service providers. In such circumstances, Custom Packaging will notify the customer as soon as reasonably practicable and make reasonable efforts to resume performance at the earliest opportunity.

14. Limitation of Liability

Custom Packaging liability is limited to the cost of the products ordered. We are not responsible for any indirect, incidental, special, or consequential damages arising from the use of our products or services, including but not limited to loss of profits, loss of business, or loss of anticipated savings.

15. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Custom Packaging and is protected by United States copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States and the State of Montana, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the jurisdiction of the courts of Montana, United States.

17. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modified terms.
